The Canadian Union of Postal Workers grieves that the Corporation has violated articles 9, 50 and other applicable articles and appendices of the collective agreement in that it has adopted and maintained a policy that has verifications conducted under article 50 carried out over a five (5)-day period.

The Canadian Union of Postal Workers grieves that the employer is in violation of Articles 3, 24 and other applicable portions of the Rural and Suburban Mail Carriers Collective Agreement and the Canada Labour Code in that it has, by letter dated July 13, 2004, confirmed that representatives of the Canadian Postmasters and Assistants Association (CPAA) would be the employee Health and Safety representatives at the post office level.

The Canadian Union of Postal Workers grieves that the employer has violated articles 47, 48, appendix "CC" and other provisions of the Urban Operations Collective Agreement in that it has inserted language into the Letter Carrier Route Measurement System (LCRMS) Manual that is contrary to the provisions of clause 48.04 of the collective agreement.

Following the decision by several employees to exercise their right to refuse to perform work because of work methods they deemed dangerous to their health and safety, the Corporation unilaterally adopted measures, including hiring staff, without referring the matter to the appropriate health and safety committees and without negotiating an agreement or solution with the Union. The Union was informed that the cost of this unilateral decision by the Corporation would be taken out of the financial cap set out in the collective agreement. Consequently, the Corporation violated the collective agreement.

Although the employer recognizes the need for a more effective way of understanding the hours worked by its employees, it refuses to consider the best means of collecting and using the available information. In so doing, the employer is violating the provisions of the Collective Agreement.

As of December 31, 2009, the Canada Post Corporation (the employer) has decided to stop accepting and/or processing new requests regarding the contractor start date of rural and suburban mail carriers (RSMC) hired as employees on January 1st, 2004 (contract holders, sub-contractors, replacements or helpers) for the purpose of establishing the seniority ranking of RSMCs. The employer is violating the provisions of the collective agreement and the established practice.
