The Canadian Union of Postal Workers grieves that the employer is in violation of article 2 and other applicable provisions of the Rural And Suburban Mail Carriers collective agreement in that it is requiring some of the employees covered by this collective agreement to provide their fingerprints to Canada Post.

The Canadian Union of Postal Workers grieves that the employer is in violation of Article 3 and other applicable portions of the Rural and Suburban Mail Carriers Collective Agreement in that it is not allowing individuals to maintain or obtain employment status under the provisions of the RSMC Collective Agreement if they are also employed by Canada Post under the terms of a different collective agreement.

The Canadian Union of Postal Workers grieves that the employer is in violation of Articles 3, 24 and other applicable portions of the Rural and Suburban Mail Carriers Collective Agreement and the Canada Labour Code in that it has, by letter dated July 13, 2004, confirmed that representatives of the Canadian Postmasters and Assistants Association (CPAA) would be the employee Health and Safety representatives at the post office level.

The Canadian Union of Postal Workers grieves that the employer has violated Article 12 and other relevant portions of the Rural and Suburban Mail Carriers Collective Agreement in that it is failing to give priority consideration to candidates from eligibility lists when it is applying the external hiring process.

The Canadian Union of Postal Workers grieves that the employer is in violation of Appendix "E" and other portions of the RSMC collective agreement in that its representatives on the Transition Committee have failed to meet their obligations under Appendix "E".

The Canadian Union of Postal Workers grieves that the employer is in violation of article 11 and other portions or the RSMC collective agreement in that it is not notifying the Transition Committee as soon as possible or providing it with all relevant information when it is modifying routes as described in clauses 11.03 and 11.04.

The Canadian Union of Postal Workers grieves that the employer has violated article 15 and other applicable provisions of the Rural and Suburban Mail Carriers (RSMC) collective agreement. The employer is failing to provide each RSMC employee with two (2) weeks of paid vacation leave during the 2004 calendar year and is also failing to allow the leave entitlement earned during the 2004 calendar year to be carried over to the following calendar year(s).

The Canadian Union of Postal Workers grieves that the employer is in violation of article 35 and other applicable provisions of the Rural and Suburban Mail Carriers (RSMC) collective agreement in that it is using the wrong calendar year as the "base financial year" and is therefore miscalculating the "base amount", beyond which the parties have agreed to allocate an additional twenty-nine million dollars ($29,000,000) in the first year of the RSMC collective agreement.

Following the decision by several employees to exercise their right to refuse to perform work because of work methods they deemed dangerous to their health and safety, the Corporation unilaterally adopted measures, including hiring staff, without referring the matter to the appropriate health and safety committees and without negotiating an agreement or solution with the Union. The Union was informed that the cost of this unilateral decision by the Corporation would be taken out of the financial cap set out in the collective agreement. Consequently, the Corporation violated the collective agreement.

Consequently, the Corporation violated the collective agreement, and more specifically articles 1, 3, 12, 13, 24, 28, 34, and all other related provisions.

The Canada Post Corporation is refusing or failing to pay absent rural and suburban letter carriers for the designated paid holidays provided for in the collective agreement. In doing so, Canada Post is violating the provisions of the collective agreement, more specifically, but not limited to, Article 16. In addition, the Corporation is also violating legislation in situations where employees are absent for fewer than fifteen (15) days in the thirty (30)-day period prior to the designated paid holiday.

The Canadian Union of Postal Workers grieves that the employer has violated Articles 11, 33, Appendix "A" and other applicable articles and appendices of the Rural and Suburban Mail Carriers Collective Agreement in that it is treating the Sears Catalogue delivered in January 2004 as addressed admail.
