N00-08-R0021 - Introduce RHD on RSMC routes

Statement

The Canada Post Corporation informed the Union of its intention to unilaterally introduce right-hand drive vehicles (RHD) on RSMC routes. The Corporation also informed the Union of its intention to charge to the RSMC financial cap the costs associated with its decision. The employer is changing the working conditions provided under the collective agreement, including, but without restricting the foregoing, in regards to compensation. The employer is thus violating the collective agreement and applicable legislation.

Corrective Steps Requested

The Union requests a statement to the effect that the employer is violating the collective agreement and applicable legislation when it modifies the collective agreement without the Union’s agreement. The Union also requests that the employer be ordered to cancel its decision to introduce RHD vehicles on RSMC routes and to charge costs to the RSMC financial cap. The Union further requests that the employer be ordered to immediately enter negotiations with the Union. The Union finally requests that damages be awarded to the Union and/or employees who were affected or will be affected by the employer’s unilateral decision to introduce RHD vehicles. The Union reserves the right to request any additional corrective action it may deem appropriate.
